What MICRA Means to You
The Medical Injury Compensation Reform Act of 1974, (MICRA) is a series of laws intended to minimize the amount of money paid to victims of medical malpractice in verdicts and settlements.
Because of MICRA, compensation for pain and suffering caused by medical malpractice is limited to $250,000 — no matter how serious the injury.
Same Injuries, Different Results
If you sustain a brain injury or spinal cord injury in a car accident caused by negligence, you could potentially obtain millions of dollars of compensation for pain and suffering. If you suffer the very same injuries because a licensed medical professional failed to follow proper standards of care, damages for pain and suffering are limited to $250,000.
California's MICRA caps have not changed for more than 35 years, due in large part to the lobbying efforts of the American Medical Association and insurance companies. Injured individuals have no such organization to lobby on their behalf.
Because of MICRA, most California attorneys do not represent people injured by medical negligence. Medical malpractice cases are far more expensive to pursue and more challenging to win than a typical car wreck case. Most lawyers weigh the risks, costs and potential benefits and decide to avoid medical malpractice claims.
Fighting for the Rights of the Injured
Noël M. Ferris is one of the few attorneys in the Sacramento area who is committed to standing up for the rights of those injured by health care providers. She knows that caps on compensation limit lawsuits, but caps do nothing to limit malpractice.
Many cases of malpractice are never pursued. That leaves victims uncompensated and others at risk of harm from medical negligence.
Medical malpractice victims can still receive compensation for lost wages and other income caused by the negligence. However, many lawyers are reluctant to represent retired people, stay-at-home parents, children and others who do not have a significant income.
